Terms of Service

These Terms of Service govern your use of Clinvesta Regional Bank's website, mobile applications, and financial services. By opening an account or using any of our services, you agree to be bound by these terms in full. Please read them carefully before proceeding.

1. Eligibility

You must be at least 18 years of age to open a Clinvesta account or use our services. By agreeing to these terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

You must provide accurate, complete, and current information during registration and throughout the life of your account. Clinvesta reserves the right to suspend or terminate your account if any information provided is found to be false, misleading, or incomplete.

Clinvesta services are available in jurisdictions where we are licensed to operate. We do not knowingly offer services in prohibited jurisdictions and reserve the right to refuse service to any person or entity.

2. Account Registration and Security

When you register for a Clinvesta account, you will be assigned a unique account number. This account number, together with your password, constitutes your login credentials. You are solely responsible for maintaining the confidentiality of your credentials.

You agree to notify Clinvesta immediately upon discovering any unauthorized use of your account or any other security breach. Clinvesta will not be liable for any loss or damage resulting from your failure to comply with this security obligation.

You may not transfer, sell, or otherwise assign your account to any third party. Each account is personal to the registered holder and may not be used by any other person.

Clinvesta employs industry-standard security measures including 256-bit SSL encryption, two-factor authentication, and continuous fraud monitoring. However, no system is entirely secure and you accept this inherent risk.

3. Banking Services

Clinvesta offers a range of banking products including savings accounts, checking accounts, business accounts, and premium accounts. The features and limitations of each account type are described in our product documentation.

Deposits made to your Clinvesta account are FDIC insured up to $250,000 per depositor, per institution, for each account ownership category. Insurance coverage does not extend to investment products or returns.

Clinvesta reserves the right to set minimum and maximum deposit limits, impose transaction limits, and restrict account activity where required by law, regulation, or internal risk policy.

All account balances are reflected in your chosen account currency. Currency conversion, where applicable, is subject to applicable exchange rates and may include conversion fees.

4. Investment Services

Clinvesta offers structured investment plans including Bronze, Silver, and Gold packages. Each plan carries a defined return on investment, minimum and maximum investment amounts, and a specified investment cycle.

Investment plans include capital protection, meaning your original principal is returned at the end of the investment cycle. However, investment returns are projections based on historical performance and market conditions and are not guaranteed.

Past performance of any investment plan is not indicative of future results. You should carefully consider your financial situation, risk tolerance, and investment objectives before committing funds.

Investment products are not FDIC insured and are not deposits or obligations of Clinvesta Regional Bank. Investment accounts are subject to investment risk including possible loss of principal.

5. Withdrawals and Transfers

Withdrawal requests are subject to review and processing by Clinvesta's operations team. Processing times vary depending on withdrawal method and may take between 1 and 10 business days.

Clinvesta reserves the right to impose applicable processing fees or charges on withdrawal requests. Such fees, if applicable, will be communicated to you before processing is completed.

Internal transfers between Clinvesta accounts are subject to review. Clinvesta may decline any transfer request that it deems suspicious, inconsistent with account activity, or in violation of applicable law.

Clinvesta complies with all applicable anti-money laundering and counter-terrorism financing regulations and reserves the right to report suspicious activity to relevant authorities.

6. Fees and Charges

Clinvesta is committed to transparent pricing. All applicable fees are disclosed upfront in our fee schedule, which is available upon request and updated periodically.

Clinvesta does not charge maintenance fees on standard accounts. Fees may apply for specific services including expedited wire transfers, currency conversion, and certain premium features.

You authorize Clinvesta to deduct any applicable fees directly from your account balance. Failure to maintain sufficient balance to cover applicable fees may result in service restrictions.

7. Prohibited Activities

You agree not to use Clinvesta services for any unlawful purpose, including but not limited to money laundering, fraud, financing of terrorism, tax evasion, or any other activity prohibited by applicable law.

You may not attempt to gain unauthorized access to Clinvesta systems, accounts, or data. Any such attempt will result in immediate account termination and may be reported to law enforcement.

You may not use automated tools, bots, or scripts to access or interact with Clinvesta services without prior written authorization from Clinvesta.

Providing false information, impersonating another person, or creating multiple accounts for fraudulent purposes are strictly prohibited and will result in permanent account suspension.

8. Termination

Either party may terminate this agreement at any time. You may close your account by contacting Clinvesta support. Clinvesta may suspend or terminate your account immediately for breach of these terms, suspicious activity, or as required by law.

Upon termination, any outstanding balance in your account (excluding investment returns not yet matured) will be returned to you via a method determined by Clinvesta, subject to applicable fees and legal holds.

Provisions of these terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Clinvesta shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, Clinvesta services.

Clinvesta's total liability to you for any claims arising under these terms shall not exceed the amount of fees paid by you to Clinvesta in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any dispute arising from these terms or your use of Clinvesta services shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.

Clinvesta reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of its intellectual property rights.

11. Changes to Terms

Clinvesta reserves the right to modify these terms at any time. Material changes will be communicated via email to the address registered on your account at least 30 days before taking effect.

Your continued use of Clinvesta services after the effective date of any changes constitutes acceptance of the revised terms. If you do not agree with the changes, you must close your account before the effective date.
